Facts Found

The protest is valid. There were no objections to the members of the Jury.

CYCA General Conditions of Racing 16.5(c) states: The area between Shark Island YA Mark (SIM) and Shark Island is a continuing obstruction and no boat shall pass between them.  RSYS Sailing Instructions require yachts sailing in the Alternate Harbour course 14 to round both the YA mark south of Shark Island and Shark Island.

6595, 4863, 4045 & 508 rounded the YA Mark and passed between the Shark Island South Cardinal mark and the YA Mark sailing in a north direction and did not round Shark Island. 6595 4045 & 4863 acknowledged that they had sailed the incorrect course and have retired from the race. 

508 attended the protest hearing and confirmed that he had also sailed the incorrect course and retired from the race.

Decision

508, 4045, 6595 & 4863 are to be scored RAF in CYCA SOPS Race I and RSYS SOPS Race 2
